4.1

Presentation of a Proclamation Honoring the 50th Anniversary of Emergency Medical Services (EMS) and Proclaiming May 19-25, 2024 EMS Week in the City of Chula Vista

The proclamation was presented.

Mayor McCann announced, pursuant to AB 23, that he and all Councilmembers would receive $50 for their attendance at that Housing Authority meeting, held simultaneously with the City Council meeting.

CONSENT CALENDAR (Items 5.1 through 5.6)

Item 5.4 was removed from the consent calendar at the request of Mayor McCann.

City Attorney Verdugo announced the existence of council conflicts on Item 5.5 and requested that Councilmembers share the nature of their conflicts.

Mayor McCann disclosed a potential property-related conflict on Item 5.5(b), and Councilmember Morineau disclosed a potential financial conflict of interest on the entire item.

City Attorney Verdugo announced that Item 5.5(b) required a 4/5 vote and that under Government Code Section 87101, the rule of necessity applied, allowing a member with a financial interest to participate in a decision if their participation is legally required for the decision to be made. However, because Councilmember Morineau's conflict pertains to regulations under the Code of Federal Regulations related to HUD grant funding, she was not allowed to participate under the state law rule of necessity. Consequently, Mayor McCann was permitted to vote on this item despite his real property-based conflict.

5.2

Otay Ranch Village Eight East: Adopt Ordinances Amending the Otay Ranch Village Eight East Planned Community District Regulations and Approving a Zoning Change

Chris Le

I urge the council to vote no on this item as written. The changes eliminate more than 8 acres of community park space. While the applicant proposes adding manufactured open space, this does not compensate for park space that families are more likely to use. The open space is located in a place that is convenient for the applicant and not in the best interest of future residents. This amendment reduces the number of detached homes, which are already difficult to find in this part of Chula Vista. Applicant proposes an elementary school site that would be utilized as a "high" residential land use if Chula Vista Elementary School District declines the space. CVESD has been delaying the addition of new schools citing a decreasing school-age population. This increases the likelihood that this site will be used for homes. The City should not allow more "high" residential land use and instead, designate it as a less dense residential area. While a traffic study was conducted for this project, it is my opinion that it did not give proper consideration to the additional density that is now being proposed. The study claims that impacts on Olympic Parkway, particularly during peak times near I-805, are unavoidable. However, some mitigation can be provided by requiring the applicant to expedite the extension of E. Main St from Village 8 West to Village 4, which would give residents in Village 8 East an alternative to Olympic Pkwy. Finally, the noise mitigation proposals are insufficient.
